Nurgeldy Khalykov — A Citizen Illegally Held in Turkmenistan

STATEMENT of the Human Rights Platform of the Civil Movement DAYANCH — Turkmenistan On the Illegal Restriction of Freedom of Movement of Nurgeldy Khalykov The Human Rights Platform of the Civil Movement DAYANCH — Turkmenistan strongly condemns the actions of the State Migration Service of Turkmenistan against journalist and former turkmen.news correspondent Nurgeldy Khalykov. The application of Article 30, Paragraph 10 of the Law “On Migration,” under the wording “departure contradicts the interests of national security,” to a citizen traveling abroad on the basis of an official job invitation constitutes a gross abuse of power and a direct violation of fundamental human rights. Facts Nurgeldy Khalykov: fully served an unlawful four-year prison sentence; was released in 2024; has no outstanding convictions; is not under investigation; poses no threat to national security. Nevertheless, the state continues to hold him in a position of a de facto hostage, prohibiting him from leaving the country without providing any explanation, time limits, or naming the so-called “competent authority” that allegedly adopted such a decision. Legal Assessment These actions violate: Article 12 of the International Covenant on Civil and Political Rights; Article 13 of the Universal Declaration of Human Rights; the Constitution of Turkmenistan; Turkmenistan’s own migration legislation. The term “national security” is being used as a universal instrument of political persecution and suppression of freedom of expression.
